Student Data Privacy & Compliance
Insight MTSS is built for K–8 schools, and protecting student information is at the center of everything we do. Here is a plain-language summary of our commitments.
Our Promises
Schools own their data.
The school or district owns and controls all student information in Insight MTSS. We act only on its behalf.
We never sell student data.
We do not sell or rent student information, ever.
No ads. No profiling.
Insight MTSS has no advertising. We never use student information for targeted advertising or to build profiles for non-school purposes.
We collect only what's needed.
We collect only the information schools need for MTSS behavior logging and supports.
Students don't use the app.
Only authorized school staff use Insight MTSS. Students do not have accounts.
Data is deleted on request.
We delete student information when the school asks, and return or delete it when our agreement ends.
No biometrics.
We do not collect fingerprints, face scans, voiceprints, or other biometric information.
FERPA
Under the Family Educational Rights and Privacy Act (FERPA), we act as a "school official" with a legitimate educational interest. We work under the school's direct control, use student records only for the purposes the school authorizes, and do not re-disclose them without the school's permission or as the law requires.
COPPA
Insight MTSS collects student information only at the direction of the school, for the use and benefit of the school, and for no other commercial purpose, consistent with the Children's Online Privacy Protection Act (COPPA) and Federal Trade Commission guidance for schools.
Illinois SOPPA
We comply with the Illinois Student Online Personal Protection Act (SOPPA, 105 ILCS 85). We:
- ✓Sign a written data privacy agreement with each school or district before receiving student data
- ✓Publish the data elements we collect and the subprocessors we use
- ✓Maintain reasonable, industry-standard security
- ✓Notify schools of any breach of student data no later than 30 calendar days after we determine a breach occurred
- ✓Delete student data when the school requests it
- ✓Never sell student data, use it for targeted advertising, or build non-school profiles
Data Privacy Agreements
We are ready to sign the Student Data Privacy Consortium National Data Privacy Agreement (NDPA), including state-specific exhibits such as the Illinois exhibit, or your district's own data privacy agreement. To request one, contact privacy@insightmtss.com
Parents
Parents have the right to review, get a copy of, correct, and request deletion of their child's information. Because the school controls student records, please contact your child's school first. We will help the school respond.
